Affordable Pool Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website located at affordablepool.com (the “Site”), and your relationship with Affordable Pool (“Affordable Pool,” “we,” “us,” or “our”) in connection with the pool repair, maintenance, decking, and renovation services we provide (the “Services”). By accessing or using the Site, requesting a quote, or engaging us for Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our Services.
You must be at least 18 years old and have the legal authority to enter into these Terms to use the Site or request Services from us.
Affordable Pool provides commercial and residential pool services, including repair, maintenance, decking, equipment services, inspection and safety review, leak detection, resurfacing, renovation and remodeling, and tile and coping services. The specific scope, pricing, and timeline for any project will be set out in a separate written estimate, quote, or service agreement between you and us.

Specific pricing, deposit requirements, payment schedules, and payment methods for any Services will be set out in your individual estimate, invoice, or service agreement. Unless otherwise agreed in writing, payment terms stated in that document govern the specific project, and these Terms govern your general use of the Site and our marketing/scheduling communications.
We stand behind the quality of our work and, where applicable, provide a workmanship guarantee as described in your specific service agreement. Except as expressly stated in a written service agreement, the Site and all information on it are provided “as is” and “as available,” without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by law, Affordable Pool and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Site or these Terms, even if we have been advised of the possibility of such damages. Our liability for Services performed is governed exclusively by the terms of your specific written service agreement.
You agree to indemnify and hold harmless Affordable Pool and its owners, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or your misuse of the Site.
The Site may contain links to third-party websites and social media platforms. We do not endorse and are not responsible for the content, products, services, or privacy practices of any third-party sites.
We provide Services in New Hampshire and the surrounding New England region. Listing of a service area on the Site does not guarantee availability for every project; please contact us to confirm service availability for your location.
These Terms are governed by the laws of the State of New Hampshire, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in New Hampshire, and you consent to personal jurisdiction in those courts.
We may revise these Terms from time to time. The “Effective Date” above reflects the date of the most recent revision. Your continued use of the Site or our Services after changes are posted constitutes your acceptance of the revised Terms.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
